Animal Attacks

Approximately two percent of the U.S. population, or 4.7 million people, are bitten by dogs every year. Other types of companion animals - cats, snakes, ferrets - sometimes attack as well. Animal bites can result in life-altering injuries, such as permanent disfigurement or scarring. Large dogs can cause injuries by knocking a person to the ground, sometimes just by being overly friendly.

Illinois law makes clear that unless the attack was provoked, the owner of the animal is responsible for the animal's behavior. It is not necessary to show prior vicious tendencies in order to prove owner liability. It is also not necessary that the animal actually make physical contact in causing an injury.

Recovery from an animal attack can be a long and painful process. Victims can recover for their medical bills, lost wages, pain and suffering, future medical care, and loss of a normal life. Both physical and psychological injuries are compensable. Claims may be brought against the animal owner or a third party who was negligent in causing the attack. Typically, claims are made against and paid by the animal owner's homeowner's insurance.

Here are some things you should do if you've been the victim of an animal attack:
  • Seek immediate medical attention.
  • File a police report as soon as possible after the attack, and request a copy of the police report.
  • Obtain the name and address of the animal owner.
  • Obtain the names, addresses, and phone numbers of anyone who witnessed the attack.
  • Take photographs of your visible injuries.
  • Take photographs of the animal if possible.
  • Do not speak with the animal owner or his or her insurance company.
  • Keep a log of all of your medical treatment and bills as well as your physical complaints.
  • Be aware that if you accept any money for your injuries or sign a release, you may be waiving your right to receive substantial additional compensation.
  • Retain an attorney who is experienced in the area of animal attack litigation at your earliest opportunity to protect your rights.
