Wrongful Death

Wrongful death" is when a person's death is caused by the wrongful or negligent conduct of another. A wrongful death case may arise out of a motor vehicle accident, a construction accident, medical malpractice, a defective product, or a variety of other circumstances.

Under the Wrongful Death Act, a victim's family members have a cause of action for the economic and emotional losses suffered when a loved one is killed. For example, a surviving spouse is entitled to recover for the loss of support, services, love, and affection as well as her own grief and sorrow as a result of the death. If there are any surviving children, each child would have a cause of action for the loss of financial support, love, companionship and guidance he or she received from the parent. Other family members may also be able to pursue separate claims.

The victim's estate may also have a cause of action, called a survival action, for damages including any medical bills and any pain and suffering the victim experienced prior to his or her death.
