    How do I know if I have a personal injury case?

    Are my medical bills paid in an injury settlement?

    Yes, payment or reimbursement of medical bills will be a component of any settlement that in an injury-related insurance claim or lawsuit. The plaintiff and or claimant will be compensated for all medical treatment necessitated by the accident including reimbursement for medical bills already paid, and a plan for payment of all future necessary medical treatment.

    Also, when it comes to getting compensation for medical bills that have already been paid, if your provider already paid some or all of the bills that you later get compensated, your health insurance provider may have a lien on part of your settlement.

    Should I get money for “pain and suffering” in my settlement?

    If you were injured in an accident, and you were not at fault, you may receive some amount of money for your pain based on the impact the injury has had on your daily life. In accidents with minor, short-term injuries, it may be a small “token” amount. When injuries are more serious, painful, and/or long-lasting, the settlement of the pain and suffering portion will increase.

    • ​​Seek immediate medical attention.
    • Ensure that a police report is made as soon as possible after the collision and request a copy of the police report.
    • Obtain the name and address of the other driver(s) involved in the collision, the name of their insurance company, the policy number, their driver’s license number, and plate number.
    • Obtain the names, addresses, and phone numbers of anyone who witnessed the collision.
    • Report the collision to your insurance company.
    • Take photographs of the damage to all vehicles if possible.
    • Take photographs of the scene of the collision.
    • Do not speak with the other driver(s), their insurance company or investigator, or any witnesses.
    • Keep a log of all of your medical treatment and bills as well as your physical complaints.
    • Attend any traffic court hearings for citations issued to the other driver pertaining to liability.
    • Do not talk to any insurance companies without consulting with an experienced auto accident attorney.
    • Retain an attorney who is experienced in the area of motor vehicle accidents at your earliest opportunity to protect your rights.​
